USER AGREEMENT
Terms and Definitions
Contractor (Administrator) — Individual Entrepreneur Kapultsevich Maxim Igorevich, an operating entity within the territory of the Russian Federation.
Client — An individual or legal entity receiving the service.
User — An individual or legal entity using the Administrator’s services and applications.
Order — A service performed by the Contractor.
Product — Work/service performed by the Administrator, transferred to the Client upon purchase.
Copyright — The right owned by the Contractor to the applications and services.

2. General Terms
2.1. This Agreement comes into force after payment or upon the start of use of free services and applications.
2.1.2. The Client automatically agrees to all terms after payment and has no claims against the Administrator.
2.1.3. The User automatically agrees to all terms of this User Agreement and has no claims against the Administrator upon starting to use free services and applications.
2.2. The intellectual property rights to the services and applications belong to the Administrator, while the result of paid services belongs to the Client. However, the Administrator reserves the right, with the Client’s consent, to publish the work result in the project’s social media as a portfolio.
2.3. The Administrator reserves the right to make edits to this User Agreement by notifying Clients accordingly. (If an order was placed before the changes to the Agreement, the previous terms apply; however, changes take effect for the next order.)
2.4. After payment for the service, the Terms of Reference are discussed, and the work is performed strictly in accordance with them. Additional elements beyond the Terms of Reference may incur an additional fee in some cases. If the work has not yet begun, or if the Client disagrees with the order details (e.g., additional fee) after discussing the Terms of Reference, the Client has the right to cancel the order and receive a refund.
2.5. All services come with a warranty period of 14 calendar days, during which errors are corrected free of charge. Ongoing support and its fees are discussed individually.
2.6. The service delivery period is up to 30 calendar days.
2.7. Support for applications (Online/Android) has an indefinite term. Applications are constantly updated, functionality is added, and errors are fixed; however, the Administrator may suspend support at any time.
3. Obligations of the Parties
3.1. The Administrator has the right to:
3.1.2. Respond to Clients only on business days, which are Monday, Tuesday, Wednesday, Thursday, Friday from 10:00 AM to 5:00 PM (Moscow time). Weekends and holidays are entirely non-working days.
In practice, the Administrator may respond outside of working hours and on holidays, but this is not an obligation of the Contractor to Clients.
3.1.3. Terminate cooperation with the Client if the Client violates this User Agreement.
3.1.4. Fulfill the order within the specified timeframe agreed before payment by the Client.
3.1.5. If the service is not provided within the timeframe specified at the time of purchase due to the Contractor’s fault, the Administrator undertakes to cancel the order and refund the money to the Client.
3.2. The Client undertakes to:
3.3.1. Pay the full amount of the service as specified by the Administrator.
3.3.2. Not violate the User Agreement.
3.4.3. Not transfer intellectual property to third parties. The development (services/applications) is protected by the Civil Code of the Russian Federation, Chapter 70, Article 1255 (Copyright).
3.5.4. Specify all project details in the Terms of Reference after paying for the service or in the order notes at the time of placement.
4. Payment
4.1. Payment for the service is made through the Robokassa service.
4.2. All payments for paid services and products are made using Russian payment systems.

6. Refunds
6.1. Refunds are not possible once the service has begun; only error correction is available during the warranty period of 14 days. If an order is canceled before work has commenced, the Client has the right to receive a refund in accordance with clause 2.4.
7. Free Services and Applications
7.1. The Administrator makes available developments (services/applications) for free use, to which the Administrator holds the Copyright.
7.1.2. The User has no rights to:
7.1.2.1. Distribute, resell, claim ownership, or change names for the purpose of sale.
7.1.3. The User has the right to:
7.1.3.1. Upload videos to social networks that display our development (application/service) with attribution to the author.
8. Kiosk: App Store
8.1. The Administrator has developed and launched an app store called Kiosk.
8.1.2. The User has no rights to:
8.1.2.1. Distribute, resell, claim ownership, change names for the purpose of sale, or publish applications that violate the law or the internal rules of the service.
8.1.3. The User has the right to:
8.1.3.1. Create an account, create a developer profile, publish applications, delete their account and their own applications, and rate applications posted in the app store using reviews.
9. FlashGames: Game Platform
9.1. The Administrator has developed and launched a game platform called FlashGames. The User agrees to the publication of a public nickname on the website.
9.1.2. The User has no rights to:
9.1.2.1. Distribute, resell, claim ownership, or change names for the purpose of sale.
9.1.3. The User has the right to:
9.1.3.1. Create an account, delete an account, rate games posted on the platform using reviews, and not use their real name in the «nickname» field.*
